I finally got a copy of this software but couldn't run it on Windows 7, so I just opened the CD-ROM and ripped the files (lol). I translated the included soundtrack and I have gotten the OK from Enterbrain that these can be used in commercial products (provided it's made with an Enterbrain engine). Gives off that vibe that can be comical instead of extremely serious.

I would expect that your ability to use them within a commercial project is because you purchased the package itself that contained the EULA license with that permission. Seeing you have Dating Sim Maker 2 would afford you that. But I wouldn't say that anyone else has that permission unless they too have Dating Sim Maker 2. They can use it or download it, but not have it in a commercial project of their own (of any eBrain project) unless they too had the license.
Other RTPs have been available for free download, such as XP's and VXAce's, so I don't have a problem with this attachment.

See, that's the thing, with this software there is no "License" (from what I can tell). At the time I don't think they really thought anything made with their software would be sold. When I emailed them it took them several weeks to get the "ok" from Enterbrain Japan.
I also can't seem to find a place to buy this as software. I got lucky and found it on ebay as I was browsing through, snagged it immediately.

I was not aware that Enterbrain had a Dating Sim Maker among all the Makers they've made. Or two, for that matter XD
They really seem to have steped in many possible directions =)
And the music is quite nice once again.

So as long as you own legal copies of the engine you're using AND the engine to which the resources belong, yes, you can use them.
Note - I don't know how you would get resources from a console engine onto the PC to use. And keep in mind that the older makers (2K, 2K3) are NOT legally available in English so you would have to have purchased a Japanese version.
Granted... Enterbrain's website still sells RPGMaker 2000 and RPGMaker 2003 (© 2002 :p ) in Japanese, so you could buy those and hold the license to use their material in commercial products too.

Even if you can't use it, the music is nice =)
I like having a seleciton of tracks in the background while working on some aspekts of my game. If there is something Enterbrain did right in all their makers, it is the varaiety of music they have.
Not everything has to be there for the purpose of useing it, sometimes inspiration alone can be enough ^^

Well, their ruling is for commercial gain. Nothing in that discussion says you cannot use em for freebies or just for fun. Heck, you can download the VXAce RTP for free if you want. to listen to some tunes
