“We have identified the issue and developed a clear plan to fix it. This is a localized situation affecting less than 30 apartments out of over 1,600. At no time was the building, or any portion of it, at risk of collapse.”
At least nine neighboring buildings had to be evacuated on Tuesday after construction workers inside the 37-story building noticed that support columns had started to collapse, during work converting the former Pfizer headquarters into apartments.
Nathan Berman, managing principal and founder of MetroLoft, which is converting the office building into housing, called it a “freak accident.”
“This is a freak accident that something occurred with these two specific columns that either were not reinforced or were not reinforced sufficiently, and they gave way,” Berman said Tuesday in an interview with the Real Deal, a real estate publication.
Berman insisted that reports of the massive development on East 42nd Street’s impending collapse had been “blown a little bit out of proportion” after heart-stopping video showed buckled support columns on the 21st story.
He also dismissed accusations from Cliff Johnsen of Steamfitters Local 638 that the builders hadn’t used enough steel to support the renovations’ added weight.
“Total nonsense. This was well designed and approved by structural engineers,” he said.
He added that the building “was never at risk of collapse,” describing the issues as “fixable,” blaming the bent columns on the added weight during construction.
“It’s very simple. You add more load to something that can’t support it, it’ll give way, and that’s what happened, and now it just needs to be fixed,” he said.
Quote:MetroLoft, the developer behind the Manhattan high rise that suddenly buckled on Tuesday, is facing a $350 million-plus lawsuit at star-studded 443 Greenwich St., home to names including Rebel Wilson, Harry Styles and Meg Ryan over the last decade.
A construction defect case, alleging a number of structural flaws, initially included $250 million in compensation and insurance claims. That figure has since ballooned to $376 million over the course of the last three years of litigation.
A separate case involving alleged defects at that address has former residents Justin Timberlake and Jessica Biel as plaintiffs, though MetroLoft is not a defendant in that case.
MetroLoft has also collected a crush of other construction violations while retrofitting New York skyscrapers and former commercial buildings into luxury residences, city records show.
But chief among the complaints is the case at 443 Greenwich St, which started in 2022.
A few years earlier, when it was first developed, MetroLoft marketed the former bookbinding factory as offering ultra-luxury living and Paparazzi-proof privacy.
It quickly attracted A-list buyers like Jennifer Lawrence, Timberlake and Biel, Ryan and Styles — as well as Mike Myers — in a rush of 2017 purchases.
But shortly after moving in, some residents and board members contended the building was full of engineering and construction flaws.
The building’s condo board sued MetroLoft in 2022 for breach of contract and fraud, claiming “life-threatening” shortcuts. The allegations include leaking roofs, pouring water into multimillion-dollar penthouses and structural decay so intense that residents could pull decorative bricks from courtyard walls by hand.
Other claims by the board include the plant-filled courtyard being built without a properly functioning drainage system, leading to heavy flooding.
MetroLoft’s legal team has filed several motions attempting to dismiss the case, but New York State Supreme Court judges have declined to do so, keeping the multimillion-dollar litigation moving through discovery, depositions, and active appeals.
There are no public records or information in the lawsuit filings that indicate the alleged defects are fixed.
Quote:WASHINGTON — Vice President JD Vance and the Department of Labor’s watchdog announced a probe Wednesday into foreigners exploiting worker visas in the US in the latest crackdown on fraudsters.
At an anti-fraud event in Milwaukee Wednesday, Vance said labor officials fired off dozens of subpoenas for the investigation, so the Trump administration can ensure “American jobs … go to American workers and not foreign fraudsters.”
Labor Department Inspector General Anthony D’Esposito told The Post that the recipients of the worker visas have been used to bilk the medical industry to the tune of “hundreds of millions” of dollars as well as other employment sectors — while being run at times by forced-labor networks and human traffickers.
The DOL’s Office of Inspector General has already “uncovered widespread schemes in which employers and labor brokers submitted fraudulent applications, exploited foreign workers through coercive wage-kickback arrangements, and undercut American workers by flooding the market with below-wage labor.”
Department of Homeland Security assessments have found as much as 21% of the H-1B petitions were fraudulent.
D’Esposito also told Fox Business’ “Mornings with Maria” that, in addition to H-1B visa workers who are displacing Americans, the investigation will target employment-based green card holders.
“This is another example where fraud is fueling violent crime,” D’Esposito said, adding that the visa fraud “is tied to cartels, is tied to transnational gangs.”

“I’m fit enough at the moment, touch wood, and I’m really enjoying doing the shows,” the “Total Eclipse of the Heart” singer told Hello! Magazine in an interview published in March.
“I’m still rocking on that stage with my wonderful band, and if you’ve got your health, you’ve got everything.”
Tyler explained she kept in shape by doing Pilates for “20 minutes a day,” even when she’s in her hotel room.
She also revealed that she underwent surgery to help with issues she had been having with her knees.
“I have had problems with my knees; I didn’t have new knees, I had what they call washouts [a surgical knee procedure], which turned out to be very successful,” she told the outlet.
“So, hopefully that will last for a long time,” Tyler added.
The “Holding Out for a Hero” songstress’s comments came five months before she died on July 8. She was 75.
“Bonnie’s family and team are heartbroken to announce that Bonnie unexpectedly passed away last night in [a] hospital in Portugal as a result of the illness that she was being treated for,” a spokesperson said in a statement on Thursday.
“We will issue a further statement shortly but for now ask for privacy to deal with this tragedy,” they added.
In late April, Tyler was hospitalized after she began experiencing intense abdominal pain.
The “If I Sing You a Love Song” songstress had a serious tear in her bowel and had to undergo emergency surgery a few days later.
She was later placed in a medically induced coma, which she managed to come out of in June.
However, her team insisted her “recovery process is slow.”
Quote:WASHINGTON — President Trump opened up about his final call with late Sen. Lindsey Graham in what “could have been minutes” before his death after returning from a trip overseas.
Trump, 80, described Graham, 71, as “family” to him and said he was absolutely shocked by the senator’s abrupt passing.
“What makes it even stranger is that I got a call last night, sometime [in] the early evening,” Trump recalled to NBC News’ “Meet the Press” on Sunday, indicating it may have been around 7 o’clock.
“He said we’re all set for the SAVE America Act. He was pushing the SAVE America Act like crazy. He got back and said he just landed from Ukraine. I said, ‘That’s a long trip to make.’ He sounded a little tired, but perfect. But a little bit tired.”
Graham died of a “brief and sudden illness” Saturday evening, according to his office. Graham had made multiple phone calls before his sudden death, including with CBS News anchor Margaret Brennan, and was slated to appear on her “Meet the Press” show Sunday.
“He’s going to be appreciated more now than he was when he was living,” Trump predicted.
“He’s a tough one to lose. He was great — he was unique in every way,” the president added. “He was like a member of the family to me. It’s very tough.”
Over 11 years ago, Trump and Graham were bitter rivals in the 2016 Republican presidential primary. Graham warned Republicans against nominating Trump, arguing that he would be ruinous for the party.
They clashed so much that, at one point, Trump read aloud Graham’s cellphone number at a rally. The late senator then cut an ad showcasing him destroying his cellphone in various ways. Graham had been peeved at Trump for dissing his friend, the late Sen. John McCain.
After Trump first became president, he and Graham initially remained bitter foes. But slowly, Graham began to warm up to Trump and, in 2018, mended fences with him after his viral defense of now-Supreme Court Justice Brett Kavanaugh.

Iranian Supreme Leader Mojtaba Khamenei, who hasn’t been seen publicly since Operation Epic Fury began in February, vowed Saturday to avenge his father “and all the martyrs of these two wars from the criminal and disgraced.”
Graham, 71, died suddenly Saturday from a “brief and sudden illness.” Emergency dispatch calls suggest he reported chest pain and then a heart attack.
But Graham’s famously hawkish foreign policy stances earned him many enemies around the world.
The late senator had been Trump’s foremost backer in Congress of the war in Iran, repeatedly advocating for the use of military force and casting doubt on the chances peace negotiations would be successful.
Just before his death, Graham was in Ukraine, where he toured a drone facility from the defense company SkyFall and met with the country’s President Volodymyr Zelensky.
During his meeting with Zelensky, Graham remarked on how the Ukrainian leader had a positive meeting with President Trump in Turkey days earlier at the NATO summit there.

Khamenei issued the threat days after the Islamic Republic buried Ayatollah Ali Khamenei, 86, more than four months after US-Israeli airstrikes obliterated his Tehran compound on Feb. 28.
“We pledge to avenge the blood of the martyred leader and all the martyrs of these two wars from the criminal and disgraced killers,” the younger Khamenei wrote on Telegram.
“Whether we are here or not, this will be achieved, and soon individuals among the freedom-seekers across the world will each carry out part of this divine mission.”
Khamenei said the vengeance “must certainly” take place and that it would depend not only on Iran but also on “free people around the world.”
The ruler was not at his father’s nearly weeklong funeral procession and has not been seen publicly since he was appointed supreme leader on March 8.
Ayatollah Ali Khamenei, who ruled for 37 years, was buried Thursday in the country’s holiest shrine, according to state media, which also claimed as many as 43 million people participated in the ceremonies.
The supreme leader’s rhetoric was his first message since the funeral ceremonies began a week ago — and came just one day after President Trump told The Post that he has “left instructions” should the Iranian regime succeed in their ongoing efforts to try to kill him.
Tehran has repeatedly called for Trump’s death ever since he ordered the drone attack that killed top Iranian general Qassem Soleimani in 2020.

The mourner, seen in the front row helping lead prayers for the assassinated supreme leader, was wearing a baseball hat and was covered in a black mask.
But it turned out to be Mohammad Javad Khamenei — the slain ayatollah’s eldest grandson, Iran International reported.
Javad Khamenei was badly injured and suffered severe burns to his face during the Feb. 28 US and Israeli airstrikes that killed Ali Khamenei, 86, and also badly disfigured Mojtaba Khamenei, according to US intelligence reports.
Javad Khamenei is the son of Ali Khamenei’s oldest son, Mostafa Khamenei, who was born around 1965, according to the outlet.

“Iran made a poor choice. Now they pay,” Secretary of War Pete Hegseth posted on X.
US forces pounded the Islamic Republic late Saturday, striking 140 targets including missile and drone sites, naval assets, ammunition storage facilities, communication networks, and surveillance locations, United States Central Command said in a statement.
Over 300 targets inside Iran have now been hit since the regime first violated the fragile cease-fire by launching missiles at commercial ships traversing the Strait of Hormuz on July 6, the agency added.
The strikes were launched after Iran’s powerful Revolutionary Guard Corps (IRGC) Navy attacked the M/V GFS Galaxy, a Cyprus-flagged container ship, and declared the crucial waterway closed.
A civilian crew member from the ship is now missing and the vessel suffered significant engine room damage in the strikes, CENTCOM said.
Iran also targeted other ships navigating the strait, and the US shot down several drones, an official told the Wall Street Journal.
The US vowed that Tehran would pay a “heavy cost” and said that the retaliation, which began at 7:15 p.m. ET, was being carried out under the direction of the commander in chief, President Trump.
“Iran was provided yet another opportunity to demonstrate adherence to the Memorandum of Understanding after being held accountable for earlier attacks on commercial vessels but has again failed,” CENTCOM said in a statement on X.
Explosions were heard in the southern Iranian coastal cities of Bushehr Chabahar and Asaluyeh early Sunday local time, Iranian state-run media reported.
Iranian state media claimed that military buildings were hit in the Busehr strikes, and a military site in Deyr was also hit.
There were also strikes in the city of Kagan, which is near Iran’s vital South Pars oil and gas field, and in Jask, according to the New York Times.
Additional strikes were reported deeper inside Iran, including in the city of Kerman, which is 300 miles away from the coast, CNN reported.
The regime responded to the fierce US retaliation by launching wave of attacks on multiple US allies in the region.

Footage of both areas – which sustained extensive damage during US and Israeli-led bombing campaigns that began in late February – reveal “major signs” of activity, according to CNN, which obtained images from private firms.
Such construction likely runs afoul of the Memorandum of Understanding that Iran and US negotiators reached last month during a cease-fire that President Trump called “over” this week following Iranian attacks on shipping vessels in the Strait of Hormuz.
US and Israeli forces repeatedly targeted the Parchin site, which the Iranians had covered with a protective concrete shield, in the joint air campaign that was launched on Feb. 28.
But a series of large blast holes, which were clearly visible on June 10, had been covered over 12 days later.
By July 7, the damage was covered with mesh material and concrete mixer trucks were visible at the ready nearby.
It shows “significant, new attempted reconstruction activity,” wrote David Albright, founder of the Institute for Science and International Security in a Saturday analysis of the information.
“While imagery from early June indicates damage assessment and clean-up, including the removal of debris and temporary covering of the three impact holes of the buried facility, the newer imagery shows renewed activity at the impact holes for more permanent sealing as well as additional concrete hardening of the site,” according to a new paper published by the organization Saturday, as Iranian and Omani officials met in Muscat while staring down the barrel of a US ultimatum to keep the strait open.
The Parchin Military Complex has long been suspected of housing secret nuclear activities.
International Atomic Energy Agency inspectors visited the site in 2004 and 2005, and said they were denied access to certain areas in 2006.
Quote:Treasury Secretary Scott Bessent imposed sanctions Friday on Iranian Supreme Leader Mojtaba Khamenei’s alleged Dubai-based moneyman Ali Ansari, three Iranian currency exchanges and alleged front companies in Hong Kong and the UAE that link Tehran’s banks to the global economic system.
Bessent announced the latest financial squeeze following two nights of resumed US airstrikes on Iran and a third conducted by an unknown country — prompted by Iranian attacks Monday and Tuesday on three commercial ships in the Strait of Hormuz.
“The so-called Supreme Leader is hiding in seclusion while his regime crumbles. Treasury will continue using every tool at its disposal to isolate him and other regime elites from the global financial system,” Bessent said. “We will preserve these assets for the Iranian people.”
A statement from the Treasury Department, which has led a so-called Operation Economic Fury to support President Trump’s military effort to force Iran to relinquish its nuclear program, says Ansari “oversees a sprawling global network of assets benefitting Iran’s leader.”
“Ansari has effectively institutionalized large‑scale embezzlement within the Iranian regime, diverting publicly funded wealth into an extensive overseas portfolio of real estate and commercial holdings,” the department said.
He previously owned the US-sanctioned and Tehran-based Ayandeh Bank, which went bust last year after racking up billions in losses — before Mojtaba, then known as the influential “power behind the robes,” succeeded his aging and ultimately assassinated father as supreme leader.
The bank “racked up billions in debt as it issued loans backed by the Central Bank of Iran to Ansari’s own companies and commercial ventures in Iran… using his publicly funded wealth to simultaneously expand an overseas business empire on behalf of Mojtaba Khamenei,” the Treasury Department said.
Through a company registered in Saint Kitts and Nevis, the banker has since 2011 allegedly scooped up property and investments in Cyprus, Germany, Luxembourg, Spain, the UAE and the UK.
“Although held in Ansari’s name, many of these financial interests are ultimately held for the financial benefit of Mojtaba Khamenei, his family, and other Iranian elites,” the department said.

Quote:WASHINGTON — President Trump claimed Monday that he asked FIFA supremo Gianni Infantino to review US striker Folarin Balogun’s red card, which would have kept him out of an elimination match against Belgium — with Trump admitting that “I didn’t think it was a foul.”
“I didn’t tell [Infantino] what to do,” the president responded to a Post reporter’s question in the Oval Office. “I can’t tell him what to do, but — and I don’t believe he made the decision. I think it was a committee that made the decision, and they made the right decision — because number one, it wasn’t a foul, and you want to see a game with your best players.”
FIFA shocked the world Sunday by announcing that Balogun’s one-match ban, typically an automatic consequence of any red card, would be suspended for up to one year, clearing the US star to play in Monday night’s match.
“I asked for a review because I didn’t think it was a foul, and you know, again, I’m good at this stuff,” Trump said. “I didn’t think it was a foul. I thought it was two great athletes that crashed into each other and got entangled.”
In a statement just before noon Monday, Infantino confirmed: “I regularly discuss matters related to the FIFA World Cup with the President of the United States, and on this matter, I did receive a call from President Donald Trump … During our conversation, I explained that there was an ongoing legal process involving FIFA’s independent judicial bodies and that the case would be decided in due course by the competent bodies. That is how FIFA’s system works, and it is a principle that I will always uphold.”
The Brooklyn-born Balogun, who plays professionally for AS Monaco in the French league, was sent off by Brazilian referee Raphael Claus in the second half of the USA’s 2-0 win over Bosnia and Herzegovina in the round of 32 July 1.
Claus ruled after video review that Balogun had committed a red card offense after the striker appeared to accidentally rake the back of Bosnia defender Tarik Muharemović’s leg and spike his ankle.
FIFA found that Claus and video assistant referee Juan Soto of Venezuela had misapplied protocols by using slow motion to determine the severity of the foul. The referee initially ruled that Muharemović had fouled Balogun before being called to the video monitor.
“They say they don’t show them in slow motion,” Trump said, “because it’s so different. Because you’ll take one little quarter of a second, and you’ll see that a hand is touching a neck, or you see something, whereas when you see it in fast motion, it will look like two guys collided, which is really what happened. They got sort of entangled.”

Making matters even more frustrating for fans of the USMNT is that the referee who gave out the red card has a less-than-perfect past when it comes to trouble.
Raphael Claus was previously accused of match-fixing, and he was the man on the whistle on Wednesday night.
The accusations took place in Brazil's first division in 2023.
He was accused of giving out "irregular red cards."
The accusations stemmed from the owner of Brazilian club Botafogo, who submitted audio recordings that featured a different official claiming refs were taking bribes.
Claus was called to testify, along with his VAR at the time.
The Brazilian Football Confederation found no proof of any wrongdoing by Claus.
So yes, there was an accusation, but nothing more was leveled against Claus at the time.
FIFA clearly trusts him as a top official, but that worked against the U.S. and Balogun on Wednesday night.
Quote:Norway boss Ståle Solbakken agreed with the notion that the overhead wires deserve an assist for England's equaliser as the ball dropped down "straight from heaven" despite FIFA's ball sensor showing no contact.
Jude Bellingham's brace secured a 2-1 quarter-final victory that went to extra-time in hot and humid Miami, where Andreas Schjelderup's cross-shot had given the Scandinavians the lead.
Bellingham cancelled out the opener with a smart finish in first-half stoppage-time, with England breaking quickly after Ørjan Nyland's goal kick was cut out.
The ball appeared to hit one of the overhead TV cables, but FIFA says the chip in the ball did not record anything.
A statement from the governing body read: "Before England's goal in minute 45+2 against Norway, the sensor in the connected ball showed no peak in the 'heartbeat of the ball' when in the air, and therefore no evidence that the ball touched the overhead wire and changed the movement of the ball."
Solbakken was asked at the start of the post-match news conference whether the camera wire deserved an assist for the leveller, with the Norway boss saying: "Yeah, it probably will.
"That was unlucky for us. The ball fell straight down from the sky, so it changed its direction.
"It became a misunderstanding among our players and it was in a bad moment for us, but we can't do anything about that.
"I don't think we will play the game again, so that's how it is."
Solbakken did not see the ball hit the wire but many on the Norwegian bench did, even if it was not picked up by FIFA.
"I can't say anything about that because FIFA," he said. "If there's no been no sound or there has been no [reading] in the chip, what can I say against that?
"But the ball drops down straight from heaven says everyone, including Ørjan, who is the goalie, including the guy who is going to receive the ball.
"I saw another way just then, so I wonder also what happened. I think it's pretty clear that it did and it was a strange thing."
It was a painful end to a summer to treasure for Norway, who marked their first World Cup since 1998 by going deeper in a major tournament than ever before.
