That is a big nope.

The author explained that there was a 'tendency of the DM to railroad' the players, as in it was DM vs Players in a more adversarial role. That and the one playing the Kender was a friend of the DM.

Given that the Kender's player is a friend, I have no doubt the DM wasn't interested in constraining the Kender. He placed an adversary, his friend, right into the party.
