Youtube Loses Lawsuit

No. Stealing is stealing any way you look at it. If I could use your argument, I could walk out with an 2001 Epiphone Firebird Electric Guitar retailing at $700 because I didn't have the money for it.

I have one in my store, but I'm not about to let it go for zilch.

I disagree with your point entirely, Dervv. They have an opportunity to adapt to new media, but they refuse to. I agree, stealing is wrong, but they don't make it easy for people to get their stuff anyway. And I mean that relatively. It should be as simple as putting a status update on Facebook.

not like luxury stuff like a guitar, standard of living stuff like shows/music/heat/food. probably should have been clearer on that... i know it sounds stupid and doesn't hold up well, but if you've ever been in the position of having to stuff a box of pasta under your coat, maybe you'd think the same way.

I read what you've stated, but just saying that they need to change their ways does absolutely nothing. You've given that argument at least twice in this thread, but it would be appreciated if you would give a few working examples.

And even if they do create a new method, it would not prevent the free sharing of copyrighted merchandise.

Be that as it may... note that this could permit other filesharing sites that have copyrighted material to be under fire.

I did give working examples. In fact, my argument was based around a working example. Ad revenue sharing. ;)

And again, if the service is getting the merchandise from private individuals for free and the corporation is unaware... they garner nothing. Youtube may have advertisements, but those that sued them obviously received no notification of theirmusic being posted, nor revenue until the suit was filed.

This goes back to why the site was sued in the first place. I cannot fault the filesharing site because they may have measures to remove the media. But it was those that pirated the media and illegally posted it that caused the issue. Please don't claim that the industry is the victim when it is the persons who stole the media are the ones responsible.

Yes, I'm aware of that, but my point is that these companies make no effort to actually use the services available to them. They just fight them instead of harnessing their massive potential.

this. if the ones sueing youtube had been the ones to come up with youtube in the first place, i bet this would be a completely different story

Well, it's a given that it is too late for GEFFEN RECORDS to make GEF-TUBE.Com. Youtube is just too big and well known. The problem inherit is that even if industries do make accounts and licenses with Youtube (and some artists are already promoting their work in there), it won't stop private individuals from posting their own copies too. I mean, I have seen videos by the actual bands in tandem with videos and compilations by other users.

PAIXYAKUMO4EVER: So what? I saw Boner4Murder's camcorder of her whole concert. Check out the massive wardrobe malfunction on the second song! There's no mistake now!
Technically, I think that they should look to see who's posting the videos. They're the ones that are actually causing the problem. I mean, anything could slip by.

Oh... like the chatroom joke? Laughing + Tongue sticking out

Yes, but lets face it, what % of companies actually do this? It wouldn't be a trend to upload copyright materials if they embraced the media outlet that is Youtube & co..
Don't get me wrong, I'm not defending the use of copyright materials for personal gain, quite the opposite. I'm just saying that media has evolved, but the old fashion model hasn't.
